Prosecutorial Activity

Prosecutor is the party bringing charges and participates in criminal proceedings on behalf of the state.

Prosecutor is authorized to institute criminal prosecution against a person who committed a crime, and by exercising discretionary powers may decide not to initiate or to terminate criminal prosecution, or to divert the offender from the justice system.

Prosecutor supervises the investigation to ensure criminal prosecution.

Prosecutor is the state accuser and supports the state's accusation in courts of all instances. Based on evidence examined in court, the prosecutor requests that the accused be found guilty.

Prosecutor supervises the legality of operational-search measures and decisions taken by authorized bodies that fall within prosecutorial powers under the Law of Georgia on Operational-Search Activities.

Prosecutor protects the rights of persons deprived of liberty and persons whose liberty is restricted, has unimpeded access to places of detention for inspection, questioning, and review of documents confirming deprivation or restriction of liberty, and takes measures to release them if unlawfully detained.

Prosecutor is authorized to initiate civil claims for confiscation of property belonging to certain subjects in accordance with civil procedural legislation.

Investigative Activity

The Prosecution Service conducts investigations in full in respect of crimes within its investigative jurisdiction.

Crimes within the investigative jurisdiction of the Prosecution Service are defined by the Organic Law of Georgia on the Prosecution Service and the Order of the Prosecutor General of Georgia of 30 June 2025 "On Determining the Investigative and Territorial Investigative Jurisdiction of Criminal Cases".

The Prosecution Service carries out operational-search activities in accordance with the Law of Georgia on Operational-Search Activities.
